Permitted Development Restrictions 2023


This is a list of restrictions on development that are not permitted under Class A (Rear Extensions) of Part 3 of the Schedule. Development is restricted if:

  • It has been granted permission to use the dwelling house only by certain classes (F1G, M, N, P, or Q).

  • The total area of ground covered by buildings within the dwelling house's curtilage would exceed 50% of the total area of the curtilage.

  • The height of the part of the dwelling house being enlarged would exceed the height of the existing dwelling house.

  • The eaves of the part of the dwelling house being altered would exceed the height of the eaves of the existing dwelling house.

  • The enlarged part of the dwelling house would extend beyond a wall that forms the principal elevation of the original dwelling house or a wall that fronts a highway and forms a side elevation of the original dwelling house.

  • The enlarged part of the dwelling house would have a single storey, extend beyond the rear wall of the original dwelling house by more than 4 meters (detached) or 3 meters (other) in height, or exceed 4 meters in height.

  • The enlarged part of the dwelling house would have more than a single storey, extend beyond the rear wall of the original dwelling house by more than 3 meters, or be within 7 meters of any boundary of the curtilage.

  • The enlarged part of the dwelling house would be within 2 meters of the boundary of the curtilage and the height of the eaves would exceed 3 meters.

  • The enlarged part of the dwelling house would extend beyond a wall forming a side elevation of the original dwelling house and exceed 4 meters in height, have more than a single storey, or have a width greater than half the width of the original dwelling house.

  • The development would include the construction of a verandah, balcony, raised platform, installation of a microwave antenna, chimney, flue or soil and vent pipe, or an alteration to any part of the roof of the dwelling house.

Once the design has been achieved, we will obtain a Lawful Development Certificate, or if it is required planning permission. You are now ready to build!
